Machine Guard Accidents and Amputation Dangers for Industrial Workers in Illinois and Indiana

Amputation dangers while working with machinery, equipment, power tools, or conveyor belts are well-known, and yet too many workers in some of our biggest industries are still suffering permanent harm or even dying in an amputation injury involving a machine guard.  The accident can happen in an instant, with a mechanical crushing, cutting, shearing, or tearing movement causing horrific bodily harm.  These are horrible events, where the worker suffers immediate and excruciating pain while co-workers and witnesses simultaneously suffer from having seen it happen, or the aftermath. 

While factory work obviously comes with a huge risk of an amputation injury involving a machine guard failure, workers on the job in agri-business; construction; food processing; warehousing and distribution; and waste recycling also face a great danger of being disabled or killed in a machine guard amputation accident.

What is Machine Guarding?

OSHA references the definition promulgated for “safeguarding” workers from harm provided by industrial standard ANSI B11.19-2003.  Here, safeguarding involves the protection of personnel from hazards by the use of guards, safeguarding devices, awareness devices, safeguarding methods, or safe work procedures. 

Within that standard, a “guard” is defined as a “barrier that prevents exposure to an identified hazard.”  Read, Safety, Small Business. “Safeguarding Equipment and Protecting Employees from Amputations.” Occupational Health and Safety Administration (2012) (“Safeguarding”).

Machine Guard Amputation Dangers Involving the Mechanical Components

OSHA explains that there are three basic types of dangers for amputation involving the components of the machinery, etc., and that all those with possession, custody, or control of aspects of the worksite should be alert and aware of these amputation hazards:

  • Point of Operation is the area of the machine where the machine performs work – i.e., mechanical actions that occur at the point of operation, such as cutting, shaping, boring, and forming.
  • Power-Transmission Apparatus is all components of the mechanical system that transmit energy, such as flywheels, pulleys, belts, chains, couplings, connecting rods, spindles, cams, and gears.
  • Other Moving Parts are the parts of the machine that move while the machine is operating, such as reciprocating, rotating, and transverse moving parts as well as lead mechanisms and auxiliary parts of the machine.

Machine Guard Amputation Dangers Involving Mechanical Motions

OSHA also explains the various types of movement that the machine guard must protect against, which include the following:

  • Rotating Motion is circular motion such as action generated by rotating collars, couplings, cams, clutches, flywheels, shaft ends, and spindles that may grip clothing or otherwise force a body part into a dangerous location. Even smooth surfaced rotating machine parts can be hazardous. Projections such as screws or burrs on the rotating part increase the hazard potential.
  • Reciprocating Motion is back-and-forth or up-and-down motion that may strike or entrap an employee between a moving part and a fixed object.
  • Transversing Motion is motion in a straight, continuous line that may strike or catch an employee in a pinch or shear point created by the moving part and a fixed object.
  • Cutting Action is the action that cuts material and the associated machine motion may be rotating, reciprocating, or transverse.

Those in the position to protect workers from these risks of harm should understand these dangers and undertake a careful inspection not only of the machinery, equipment, and tools but also the worksite itself.  Machine guard amputations are often complicated accidents where the failure or lack of the guard itself combined with failures in care regarding the surrounding environment; the training of the workers or supervisors; and care, upkeep, repair, or design of the machinery itself.   See, Safeguarding, pp. 9-10.

OSHA Regulations for Machine Guarding Amputation Safety Measures

Essentially, safety regulations overseen by OSHA mandate that safety protection involving a machine guard is placed at any dangerous areas of any machine, tool, or conveyor belt that the worker will be ask to work with, on, or near.  The guard must block the worker from coming into physical contact with the hazard.  Different dangers will require different types of machine guarding. 

Accordingly, machine guards on the worksite are heavily regulated.  And these regulations can be important to the worker victim of any machine guard amputation, because facts demonstrating the lack of compliance with safety regulations can help prove up personal injury claims against those parties with legal liability for their breach. 

Workers are to be protected from machine guard amputation injuries with regulations found in 29 CFR Part 1910, Subpart O, entitled “Machinery and Machine Guarding,” as well as 29 CFR Part 1926, Subpart I entitled, Hand and Power Tools.”

  • 29 CFR §1910.219, Mechanical power-transmission apparatus
  • 29 CFR §1910.147, Control of Hazardous Energy (Lockout/Tagout)
  • 29 CFR §1926.300, General requirements
  • 29 CFR §1926.303, Abrasive wheels and tools
  • 29 CFR §1926.307, Mechanical power-transmission apparatus
  • 29 CFR §1926.555, Conveyors.

Two Risks of Amputation: Traumatic or Surgical

Workers hurt because of a machine guard failure may suffer an amputation of their finger, hand, arm, toe, foot, or leg in two ways.  If the accident severed the body part, this is termed a “traumatic amputation.”  For more, read: Traumatic Amputations in Industrial Accidents.

However, a machine guard accident may not be so intense at the time but because of extensive bone, nerve, and tissue damage, the worker may face an amputation later on in their care and treatment where it is deemed medically necessary to amputate.

Consequences of Machine Guard Amputation Injury

In either instance, the amputation is a life-altering experience, assuming that the accident is not fatal.  The worker hurt in a machine guard accident resulting in amputation may face things like:

  • Emotional harm and mental health issues
  • Life-long medical treatment needs
  • Lifestyle changes
  • Occupational therapy
  • Pain and suffering (including phantom pain from the lost limb)
  • Physical Rehabilitation
  • Prosthetic limb fitting and learning how to use it
  • Relationship changes
  • Series of painful surgeries
  • Trauma for both victim and loved ones (think PTSD)
  • Work changes (loss of earning capacity; change in work able to perform; etc.).

Justice After a Machine Guarding Amputation Injury on the Job in Illinois or Indiana

Sadly, safety agencies and advocates for worker victims and their loved ones recognize that most of these tragic accidents are entirely preventable, if only the safety standards and regulations had been followed and respected. 

Maybe the guard was removed, or in need of repair.  Maybe no one bothered to train the worker.  Maybe everyone was under lots of pressure because of a delivery deadline or facing construction delay damages and safety checks got disregarded.  Maybe the guard failed because it was made of substandard materials or improperly designed for that particular use. 

For industrial workers in our part of the country working with machinery, equipment, power tools, or conveyor belts, it is vital that the worker be protected from the horrors of a machine guard amputation accident.  Too many of these injuries continue to happen in this country, and the current OSHA Emphasis Program has been extended to 2030 in an attempt to deal with this reality.
