Falling while on the job site remains a leading cause of death for construction workers, with the Bureau of Labor Statistics reporting that 34.7% of all construction worker deaths involve falls. While some of these construction worker falls from heights like roofs or scaffolding can be serious or deadly, other fall accidents on the construction site might not be catastrophic if it were not for the construction worker falling onto something that causes bodily harm.

What Causes a Construction Site Impalement Accident?
There are all sorts of construction worksites operating right now in Illinois and Indiana. From all the road construction involved with Project Rebuild Illinois, to the residential and commercial construction throughout Chicagoland and all of Indiana, workers in various trades are facing dangers each day that put them at risk of a fall followed by an impalement injury.
Construction workers need to be alert to things that put them at a greater risk for this type of horrible accident, including things like:
- Rebar that is unprotected (no rebar caps);

Bodily Harm From Impalement Accidents on a Construction Site
A fall where a human being descends from a height increases force on impact and the likelihood of severe or fatal injuries. However, even tripping or slipping on the worksite in what would otherwise be a fall with minor injuries can be life-altering or deadly when the worker cannot catch themselves before their body is pierced by an object.
Depending upon the circumstances, the construction worker hurt in an impalement fall accident may suffer serious physical injuries that include:
- Traumatic brain injury;
- Blunt force trauma damage;
- Spinal cord injury (and subsequent paralysis);

Key Regulations and Standards Protecting Against Impalement Risks
There are not only federal regulations but industrial safety standards in place to protect construction workers from being hurt on the job in a fall impalement accident. These include:
- 29 CFR §1926.701(b), which states that “…[a]ll protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement.”
- 29 CFR §1926.20(b), which provides detailed requirements for ‘accident prevention responsibilities” for employers on the construction site;
- 29 CFR §1926.21(b)(2), which defines the “safety training and education” required for both employers and employees to keep workers safe from harm; and
- ANSI/ASSP A10.9 promulgated by the American Society of Safety Professionals as the construction industry standard of the best practices in minimizing the risk of harm facing workers in construction and demolition work.
There is also the umbrella protection of the General Duty Clause of the OSH Act, which states that the employers of construction workers in Illinois and Indiana have a legal mandate to furnish their employees with a place of work that is free from recognized safety hazards that are likely to cause death or serious physical harm. Protecting Against Horrific Work Accident, Falling Onto Impairment (Like Rebar)
On any construction site, there is usually a bee hive of activity. It’s loud and hectic and all sorts of workers employed by different companies and trades are all on the job at the same time. Legal duties of safety may apply to more than one company or employer in the event of a fall impairment injury. Duties may include not only things like proper PPE, but inspecting the site and dealing with dangers like exposed rebar, lack of guards, or damaged rebar caps. While rebar is a common cause of devastating fall impalement injuries, it is not the only hazard that can pierce the body of a construction worker on the job site who loses their footing and falls.
