A Lake County jury awarded $25.8 million to a Valparaiso couple after St. Mary Medical Center failed to send critical blood-test results showing early signs of cancer. The preventable delay allowed a treatable condition to progress to Stage IV, causing life-altering harm.

This verdict reflects the jury’s clear conclusion: when a hospital fails to follow patient-safety procedures, it must be held fully accountable.

What Happened

On October 4, 2017, George “Tim” Yaros, age 70, underwent routine blood work at St. Mary Medical Center in Valparaiso. The results showed localized cancer, information that should have been immediately forwarded to the specialist who ordered the test.

Instead, the results were never sent.

For 13 months, the cancer went undetected. By the time it was finally discovered, the tumor had advanced to Stage IV, and Tim had gone into renal failure. Although he survived, he now requires dialysis and lifelong medical treatment.

The Jury’s Award

  • $21.8 million to Tim Yaros
  • $4 million to his wife, LaVonne Yaros, for her consortium claim

Independent Medical Review Confirmed Negligence

Before trial, the medical review panel found that St. Mary Medical Center failed to meet the appropriate standard of care. This independent finding reinforced what the evidence at trial made unmistakably clear: the hospital had the information, knew who ordered the test, and still failed to send the results.

Judge John Sedia later noted that the urologist’s name appeared on the medical center’s fax cover sheet, further supporting that the hospital knew exactly where the results should have gone.

Attorney Kenneth J. Allen’s Statement

Attorney Kenneth J. Allen released the following statement: “Important jury verdicts like this send a clear message: if hospitals negligently cause harm, they’ll be fully held to account. The true purpose here is to deter carelessness and enhance patient safety.”

The Yaros Family Speaks Out

While grateful for the jury’s decision, the Yaros family expressed that no verdict can undo the harm caused. Tim Yaros shared that the negligence “can’t begin to replace what was taken from us,” and LaVonne Yaros said their goal was simple: to prevent this from happening to another, younger patient.

Why This Verdict Matters

This case underscores a critical patient-safety principle: test results must be communicated promptly and accurately. When a hospital fails to follow this most basic responsibility, the consequences can be catastrophic. The Yaros verdict stands as a powerful reminder that:

  • Early detection saves lives
  • Communication failures are preventable
  • Hospitals must be held accountable when negligence causes harm
